The Australian Criminal Intelligence Commission (ACIC) is Australia’s national criminal intelligence agency. We advise senior decision makers on serious and organised crime impacting Australia. We are a full member of the National Intelligence Community, an Attorney General’s Portfolio agency, and a member of the Five Eyes Law Enforcement Group.

About the branch
The Legal Services branch is a dynamic legal practice that will offer you rewarding, challenging and varied legal work in support of criminal investigation and criminal intelligence-gathering in Australia. The branch provides a broad range of legal services to all business areas within the ACIC.

Predominantly the legal practice focusses on assisting the ACIC exercise its statutory functions which includes;
  • Strategic legal advice to the CEO and senior executive
  • Operational legal services in support of special ACIC investigations and special ACIC operations, and specialist legal advice concerning the ACIC’s coercive powers
  • Working with internal and external colleagues to advise on government reviews and to develop and respond to law reform initiatives
  • Providing legal advice and support to operational teams including in obtaining search warrants, controlled operations, telephone intercept and surveillance device warrants
  • Statutory interpretation of the Australian Crime Commission Act 2002 and other legislation relevant to the exercise of function of the ACIC
  • Providing legal advice in relation to information disclosure and information protection.
As an in-house legal team, the practice is varied and also involves providing generalist legal advice, or managing expert external legal advice relating to:
  • Probity advice associated with major procurement projects
  • Providing advice about contract law, contractual disputes, contract management, non-contractual agreements (MOUs), employment and property law (leasing), privacy and intellectual property.
About the role
The Senior Lawyer contributes to the delivery of a national in-house legal service focused on assisting the ACIC achieve our statutory objectives. The senior lawyer will support the Director deliver legal services within a multi-disciplinary environment and engages with key internal and external stakeholders on legal matters.

The scope of work performed may include:
  • Providing advice about the exercise of the ACIC coercive powers and other statutory functions;
  • Providing advice on the exercise of investigative capabilities, criminal and civil litigation matters including taking carriage of litigation in State and Federal Courts and tribunals, working with external solicitors and counsel, and appearing in court where permitted under the Legal Services Directions;
  • Providing legal advice on law reform proposals, including identifying law reform opportunities, and working with internal and external stakeholders;
  • Providing advice on employment and administrative law.
Our ideal candidate
  • Ideally has 5 years’ post-admission experience in a relevant area of law (experience in the field criminal, administrative, commercial law, litigation or law reform would be desirable)
  • Is client focused and will strive to develop innovative solutions to manage legal risks across a broad range of areas
  • Is motivated, proactive and able to identify/mitigate legal risks.
  • Has the ability to provide sound legal advice to a range of audiences and distil and communicate complex legal concepts for non-legal audiences.
  • Has a strong commitment to upholding their professional legal obligations and encouraging a culture of compliance and sound governance.
Essential qualifications
Admitted, or eligible for admission, as a legal practitioner of the High Court of Australia or a Supreme Court of a State or Territory.

Eligibility
  • If this role is being advertised as ongoing and non-ongoing, it may be offered as ongoing or non-ongoing subject to operational requirements and/or candidate preference. Where a non-ongoing position is offered, the role will be filled for a specified term of up to 18 months. A specified term may be extended up to a maximum period of 3 years.
  • Under section 22(8) of the Public Service Act 1999, employees must be Australian citizens to be employed in the APS, unless the agency head has agreed otherwise, in writing. For further information, contact the Recruitment Team.
  • The Australian community expects ACIC employees to maintain the highest levels of security and integrity. Successful applicants will be required to obtain and maintain, or continue to hold, the required security clearance for this role. All ACIC employees are required to hold a minimum Negative Vetting 1 security clearance, unless otherwise specified.
