About the Branch
The R&D Tax Incentive (R&DTI) Program is the Government’s flagship program to support Australian businesses conducting research and development (R&D) activities.
The R&DTI program sits within AusIndustry, within the Department of Industry, Science and Resources. AusIndustry delivers a range of programs to help Australian businesses grow, innovate and thrive. The Division interacts with industry, research organisations and universities, as well as businesses through a variety of programs.
The program is jointly managed by the Department and the Australian Taxation Office and has staff in various state and territory office locations.
About the vacancy
The R&DTI is a broad based, self-assessment program, providing tax offsets for some of a company’s cost of doing eligible R&D activities. AusIndustry undertakes integrity activities that require delegate decision and which can be reviewed internally and by the Administrative Appeals Tribunal (AAT). The Administrative Review Team manages all aspects of administrative review for the program, including conducting internal reviews and managing litigation in the AAT and superior courts, and works to improve the quality of decision making across the program. The team also manages complex compliance cases and is responsible for the program’s Large Business Review assurance program.
Candidates with well-developed people management, stakeholder engagement and leadership skills will be highly regarded, as well as experience in managing legal proceedings and/or knowledge of the research and development or innovation programs. Experience in delivering a government program governed by legislation is preferred, but not essential.

What you will do
The key roles and responsibilities of the role are to:
- Lead, mentor and manage a large nationally distributed team of R&DTI program specialists responsible for assessing R&DTI claims from Australian businesses;
- Make findings about the eligibility of activities claimed under the R&DTI by Australian businesses;
- Strategically manage compliance litigation in the AAT and superior courts;
- Drive continuous improvement in assessment practices and decision making and incorporate the lessons from internal and external review into how the R&DTI Branch makes decisions;
- Manage the conduct of Large Business Reviews; and
- Manage relationships with key R&DTI program users.
Notes
This process is being used to fill a current Executive Level 2 vacancy. A merit pool may be established to fill future Executive Level 2 vacancies for up to 18 months.
Eligibility
To be eligible for employment in the APS and the department, applicants must be Australian Citizens.
To be eligible for this role, candidates must have a degree in law from an Australian university or the equivalent. For clarity, this role does not require you to provide legal advice and a practising certificate is not required.
Security Clearance
These positions require a Baseline security clearance. The successful applicants will be required to obtain and maintain a clearance at this level.
