Job description

You will work in a skilled and dynamic team where you will play a key role in: Facilitating an evaluative style of conciliation for clients with disputes in a body corporate context. This includes assisting in maintaining constructive dialogue between the parties, enhancing negotiation efforts, and encouraging settlement to assist parties to resolve disputes lodged under the Body Corporate and Community Management Act 1997 (BCCM Act) and associated regulation modules.

Key responsibilities

  • Facilitate department conciliation to assist parties to resolve disputes without recourse to adjudication in a high volume legislative based environment.
  • Use effective oral and written communication to: Engage in pre-conference discussion with parties prior to department conciliation being held - Assist parties to negotiate agreements and resolve their disputes through face-to-face, telephone or shuttle conferencing - Assist parties to identify and clarify the issues in dispute - Assist parties to generate options to resolve their dispute within the legislative framework. - Assist parties to understand each other's point of view and communicate with each other
  • Draft written agreements between the parties that are consistent with the legislation.
  • Ensure the conciliation process is procedurally fair and meets legislative requirements.
  • Interpret and apply legislation, conduct research, and draw information from appropriate resources.
  • Provide information to community members and stakeholders on their rights and responsibilities under the BCCM Act and the five associated regulation modules.
  • Provide information to applicants about their conciliation applications to support them to meet legislative requirements for them to proceed to department conciliation, if required.
  • Maintain records of action taken in relation to applications.
  • Work autonomously, while also supporting other team members, and actively seek feedback about your performance from supervisors and colleagues.
