This position is in the Disciplinary Action Unit responsible for the disciplinary process in relation to licence holders.
About the role
An exciting opportunity has arisen within Building Commission NSW's Disciplinary Action Unit for a Manager, Disciplinary Action Unit. The Disciplinary Action Unit is responsible for the disciplinary process in relation to licence holders under legislation administered by Building Commission NSW.
This role will suit a lawyer with significant practical experience in administrative law and litigation and demonstrated experience in managing a large team in a high volume technical work environment. This position oversees processes to initiate and conclude disciplinary proceedings under the Home Building Act 1989, Building and Development Certifier Act 2018 and other legislation administered by Building Commission NSW.
In this role, you will:
- Manage the day to day and strategic direction of the Disciplinary Action Unit including managing a team and prepare reports about the functioning of the Unit
- Review briefs of evidence and oral and written submissions to make decisions for Disciplinary Action and prepare draft administrative decisions
- Review "Notices to Show Cause" (as to why Disciplinary Action should not be taken) and draft Notices of Decision (about taking or not taking Disciplinary Action)
- Work collaboratively with internal stakeholders including investigators, inspectors, mediators and legal officers, as well as external stakeholders including licence holders and consumers.
To be successful in this role you will have:
- Legal qualifications or relevant experience including the ability to understand legislation and apply it in a regulatory environment.
- Strong analytical and drafting skills, knowledge of investigative processes and the application of the rules of evidence and principles of procedural fairness and natural justice.
- Superior written communication skills and the ability to express complex issues in a concise and logical manner.
- Experience in a managing a large team in a high-volume regulatory agency.
- Knowledge and demonstrated experience in applying statutory frameworks governing Design Practitioners, Certifiers, Builders and other licenced entities in the building sector.

Salary Clerk Grade 11/12, with the base salary for this role starting at $139,787 base plus superannuation
