RASP Australia is currently looking for a Commercial Manager (Claims and Contracts) who is responsible for managing all aspects of commercial contracts and claims within the Construction, Engineering and Mining Sectors.
This role involves the preparation, negotiation, and administration of contracts, as well as handling Claims and disputes. The Commercial Manager will ensure compliance with legal and regulatory requirements, optimize contract performance, and protect the company’s financial interests.
Key Responsibilities:
Contract Management:
- Draft, review, and negotiate contracts related to construction, engineering and mining projects.
- Ensure that all contracts are compliant with legal standards and company policies.
- Monitor contract performance and compliance, addressing any issues that arise.
- Identify, prepare, and manage claims arising from contracts.
- Evaluate claims for validity and potential impact on the company.
- Negotiate settlements and resolve disputes to minimize financial and legal risks.
- Identify potential risks in contracts and develop strategies to mitigate them.
- Conduct risk assessments and provide recommendations to senior management.
- Maintain up-to-date knowledge of industry regulations and standards.
- Monitor project budgets and financial performance related to contracts.
- Ensure cost control measures are in place and adhered to.
- Prepare financial reports and forecasts for senior management.
- Build and maintain relationships with clients, subcontractors, and other stakeholders.
- Act as the main point of contact for contract and claims issues.
- Communicate effectively with internal and external parties to resolve issues.
- Ensure all contractual activities comply with relevant laws and regulations.
- Liaise with legal counsel as necessary to resolve complex legal issues.
- Keep abreast of changes in laws and regulations affecting the engineering and mining sectors.
- Lead and develop a team of contract administrators and claims specialists for projects.
- Provide guidance, training, and support to team members.
- Conduct performance reviews and implement professional development plans.
- Bachelor’s degree in law
- Business Administration
- Engineering, or a related field.
- Professional certification in contract management (e.g., CCCM, CPCM) or legal qualifications preferred.
- Minimum of 7-10 years of experience in contract management and claims handling, preferably in the construction, engineering and mining sectors.
- Proven track record of successfully managing complex contracts and claims.
- Strong understanding of contract law and commercial terms.
- Excellent negotiation and dispute resolution skills.
- Strong analytical and financial management skills.
- Proficiency in Microsoft Office Suite.
- Detail-oriented with strong organizational skills.
- Ability to work under pressure and manage multiple priorities.
- Strong communication and interpersonal skills.
- High level of integrity and ethical standards.
- Standard office environment with occasional travel to project sites and client meetings.
- Flexibility to work extended hours when necessary to meet project deadlines.
