About the role:
We are seeking a highly motivated and experienced Commercial Manager (Pre-Contracts) to join our team in the Corporate Head Office in Brisbane. In this role, you will be responsible for all aspects of the commercial / pre-contract review process working with the tendering and bidding team, from the start of the process to contract finalisation. You will report to the General Manager – Legal and Contracts and work closely with a range of stakeholders, including the General Manager – Pre-Contracts, our engineers, programmers and estimators, as well as our clients, to ensure that all Contracts, NDA’s, Confidentiality Agreements, Pre-bid agreements, MOU’s and Consortium agreements are balanced and provide for a fair risk profile.
Key responsibilities:
- Review, draft, prepare, and negotiate agreements, including Head Contracts, ECI and associated documents (including Pre-Bids, MOU’s etc), and an oversight over sub-contract documents with clients and vendors.
- Be able to review and understand a scope of work, project schedule, and pricing model, relevant to the drafting of the contract and associated documents.
- Ensure all correspondence relating to contract reviews, approvals sought, and ultimately positions taken are maintained to a high standard.
- Ensure that contract terms are favourable to the company and are compliant with legal and regulatory requirements.
- Identify and mitigate contract risks and disputes, working closely with senior management.
- Advise other senior management on contractual policy matters as required.
- Prepare and deliver contract-related reports and presentations for senior management and Vinci, France.
- Develop and implement contract review policies and procedures to ensure consistency and efficiency.
- Ensure reviews are completed in compliance with internal thresholds and expectations regarding acceptable risk profiles, referring anything else for approval.
- Providing assistance to project and commercial teams during the delivery phase in respect of claims, letters, and day to day commercial activities.
Requirements:
- Minimum of 5 years' experience in a commercial management or pre-contracts review role, ideally within the construction industry.
- Proven experience in drafting, negotiating, and finalising complex commercial contracts.
- Strong understanding of Australian contract law.
- Excellent communication, negotiation, and interpersonal skills.
- Knowledge of the civil infrastructure/pipeline industry
- Understanding of construction insurances would be desirable.
