The opportunity
Our Legal team comprises three teams: Legal Advisory, Legal Negotiations and Investments Legal. All teams support the General Counsel. Head of Legal Advisory is accountable for the provision of Legal advice to the business on all areas of law other than in relation to investments and contract-negotiation and disputes issues, with a focus on superannuation law, trust law, financial services law and the UniSuper trust deed.
This role will have end to end responsibility and leadership for the Legal Advisory team providing practical and commercial legal advice in support of optimal decision making at all levels of the organisation.
In addition to this you will:
- Provide high quality advice on Legal Advisory related issues of organisational significance which enables achieving the Fund's strategic goals while managing legal risk
- Lead the Legal Advisory team, empowering and coaching the team to build capability and efficiency in service delivery
- Assist the General Counsel to provide reports, advise and contribute to discussions of the Board and its committees as required
- Liaise with, instruct and manage legal advice from external law firms as required
Further, you will champion proactive legal advice and services to the business in a timely manner, including:
- trust deed interpretation and defined benefit issues
- trust deed amendments in connection with product design improvements and regulatory changes
- incidents and breaches and liaising with regulators
- superannuation law, financial services law, AML / CTF and privacy law issues
- marketing materials, product disclosure statements, financial services guides, target market determinations and other disclosure documents
About you
To be successful in this role you will have:
- Passion for superannuation and the positive impact it has on members' retirement outcomes
- Experience as a senior superannuation lawyer with leadership responsibilities
- Relevant qualifications in law
- Deep knowledge of trust law, the SIS Act, SGA Act, Corporations Act, APRA Prudential Standards and ASIC Regulatory Guides
- Significant experience working with superannuation funds, including trust deed amendments and preferably defined benefit funds
- A strong understanding of business concepts and operational aspects concerning superannuation fund administration firms
- Proven ability to exercise independent judgement on legal matters to protect the fund's legal position
- Pragmatic and logical in approach and decision making
