The Business functions in a highly regulated environment in which it is essential that interactions with various bodies be carefully and professionally managed.
The Role:
Providing the Company with accurate, timely and effective property law, construction law and commercial law advice and risk management strategies. Working with other business units, to minimise risk and deliver high quality outcomes for the Company.
Responsibilities may include:
- Risk management on all legal issues affecting the Company’s property, leasing and construction portfolio
- Interpreting laws, rulings and regulations affecting the Company's property and construction portfolio and making recommendations to the Company
- Drafting and amending pro forma documents to suit the Company’s business needs
- Working closely with the Acquisitions team to negotiate Agreements for Lease and Leases for new sites and liaising with the draughts team to facilitate completion of the documents
- Advising on all legal matters affecting the Company's property and leasing portfolio and affecting the Company’s construction projects
- Handling the purchase and sale of properties and businesses
- Providing advice regarding joint ventures, leases, sub-leases, and license arrangements
- Providing advice on easements, encroachments, subdivisions
- Drafting, negotiating, and reviewing a variety of property related transactions including leases, licenses, property management agreements, renewal documents, contracts of sale, notices etc.
- Reviewing documents prepared by junior solicitors / clerks
- Reviewing and settling construction contracts prepared by Construction Document Manager
- Advising on commercial, retail, and residential tenancy matters and on construction related matters
- Advising on stamp duty issues relating to property transactions
- Advising on property legal issues arising from other documents used in the Company e.g. CA agreements, Dealer Agreements etc.
- Regular reporting to the finance team on property sale or purchase transactions to facilitate funding and tax reporting
- Completing other ad hoc legal duties, as requested
To be successful in this role you will meet the following criteria:
- Extensive experience as a Commercial Lawyer
- Accredited Property Law Specialist
- Master’s in construction law
- Possess a depth of knowledge and ability in senior level negotiations
- Show resilience and the capacity to thrive in a fast paced, flat, and changeable private business environment
- Have sound commercial instincts to support risk assessment and development of solutions-based approaches
- Ability to strongly advocate positions within a private business environment
