Job description

The Misconduct Disciplinary Advice Unit (MDAU) is a business unit of the Incident Management Directorate (IMD) and provides expert advice while managing disciplinary processes arising from investigations into allegations of employee misconduct. The disciplinary and legislative framework of the MDAU functions is guided by common law principles, South Australian legislation including but not limited to the Public Sector Act 2009; the Education and Children's Services Act 2019, and related review and appeal processes. MDAU staff work collaboratively with other departmental units and external agencies while acting in an unbiased, impartial manner which considers the rights of individual employees. High level communications in the form of briefings to the Chief Executive or relevant delegate are required to set out the courses of action recommended and reasonably open in the various phases of disciplinary processes. 

Reporting to the Assistant Director, IMD, Disciplinary Review and Adjudication Officers are responsible for conducting disciplinary processes in line with standards and principles of natural justice and procedural fairness and preparing briefings and documents that are capable of withstanding internal and external scrutiny in line with organisational and government policy, common law and legislative standards. 

Disciplinary processes, recommendations and performance in the position are subject to significant scrutiny and timelines and must be effectively exercised to minimise risk to the safety of children and students, the well-being of employees and the reputation and financial risk of the Department.

The successful applicant is required to gain a Department for Human Services (DHS) working with children check (WWCC) prior to being employed which is required to be renewed every five years before expiry. The incumbent will be required to undertake RRHAN-EC (Responding to Risks of Harm, Abuse and Neglect - Education Care) Facilitator Lead (Masterclass) extended course or the online (Fundamentals) course which will be required to be updated every three years.
