The Security, Disputes and Operational Law Branch is responsible for providing specialist legal advice and support to enable the Department and ABF to manage legal risk for compliance, customs, security, intelligence, and enforcement activities, along with related strategic and policy initiatives.
The Operations Law (Regional) Section is responsible for providing legal advice and support for operational matters including offshore and onshore activities, ABF, trade and customs, maritime powers, aviation and maritime security legislation, intelligence gathering and the exercise of powers (including under maritime, customs and migration legislation) in an operational context.
The Section has a litigation practice, covering advice work for criminal and civil penalty matters as well as customs prosecutions. The Section also delivers legal training to the ABF and wider Department.
Operations Law (Regional) Section Legal Officers are generally co-located with internal clients including at Departmental offices in relevant precincts across the country.
Our ideal candidate
- Comprehensive understanding of, or ability to quickly obtain understanding of, relevant portfolio legislation and other legislation of general application
- Strong legal advice writing and research skills
- Detailed understanding of the Department's policy, program and operations and the political environment in which it operates
- Ability to actively manage and navigate complex legal issues.
Duties and responsibilities
- Provide legal advice including on statutory interpretation. The advice may be on high profile, complex, technical or sensitive issues and focuses on providing accurate legal analysis, options and recommendations, and the strategic assessment and management of legal risks
- Maintain detailed knowledge of specific legislation, case law, directions, instruments, principles, and issues of relevance to the Department
- Supervise and mentor more junior lawyers
- Liaise with, and actively develop and maintain working relationships across the Legal Group, the wider Department, and with external stakeholders including Portfolio Agencies
- Represent the Department's interests and positions during liaison and negotiation with external stakeholders.
Additional information
Essential Qualifications
- A degree in law from an Australian university, or a comparable overseas degree which is recognised in Australia for admission to practice
- Practising Certificate or eligibility to attain one
- At least three years post qualification experience.

Eligibility
To be eligible for the position you must be an Australian Citizen.
The successful candidate will be required to obtain and maintain a Baseline Vetting (AGSVA) security clearance and an Employment Suitability Clearance (ESC).
