We value those with sharp, analytical minds and are open to challenging the way things are done.The teamThe Companies and Small Business team is the team primarily responsible for ASIC's role in relation to the regulation and supervision of companies and Small Business to ensure sector adherence with the laws administered by ASIC and the promotion of market integrity.The team's role is focused on Sustainable Finance, corporate governance conduct and disclosure, financial reporting and audit quality, conduct of registered liquidators, and engagement with the Small Business sector.The Companies and Small Business team conducts proactive surveillance and monitoring, considers applications for relief from legislative requirements, provides specialist support to regulatory reform activities, and actively engages with relevant stakeholders to understand and respond to current and emerging industry issues.The roleAs an Analyst/Lawyer you will be accountable in this role for:
  • Undertaking risk-based supervision, identifying assessing, and actioning regulatory issues (e.g., surveillance, review, and monitoring), across the sector to ensure adherence with the law ((including identification of possible causes, impacts and the differentiation between non-adherence with the law, and conduct causing harm) and to promote better regulatory outcomes for consumers.
  • Considering applications for relief from the legislation administered by ASIC, reviewing submissions from the applicant (and third parties, as appropriate), undertaking registrations renewals, cancellations, and suspensions,
  • Considering existing policy and precedents, making sound recommendation (s) showing regulatory judgment, and settling relevant legal instrument (s) as appropriate.
  • Participating in thematic reviews of harms or problems across the sector, working as part of a team to develop appropriate solutions to regulatory issues.
  • Assisting with the identification and implementation of effective policy and regulatory strategies, interventions developing new guidance, training, systems, and processes and law reform for effective consumer outcomes.
  • Undertaking clear, accurate analysis of data and other information on simple matters, (with supervision on more complex matters), to identify and measure clear regulatory harms, determining the root cause of the harm (s), and the impact of the harm or potential harm.
  • Conducting and contributing to research and analysis on emerging issues across the sector, and writing reports, presentations and briefings for senior management and external stakeholders.
  • Identifying new ways to utilise data to deliver priorities, including effective collection, management, analysis, and communication of insights from data.
  • Working collaboratively with other teams within ASIC to enable them to carry out their roles, especially the carrying out of enforcement and compliance action.
  • Proactive liaison and engagement with internal and external stakeholders on regulatory issues encouraging improvements of industry practice.
  • Maintaining a general understanding of ASIC's legal and regulatory tools including when to use them, and an ability to use them as required.
About you
  • A relevant tertiary qualification.
  • Knowledge of, or the ability to readily acquire regulatory and sector related knowledge.
  • Experience (or strong willingness to upskill) in any or all Sustainable Finance, climate change adaptation and/or mitigation, greenhouse gas emissions accounting, sustainability and/or climate change-related reporting, ESG analytics and/or sustainability assurance.
  • Experience, (ideally gained in a corporate, consulting, government, or academic environment), assessing, challenging, and authenticating complex information, and making sound regulatory judgements.
  • Ability to apply strategic thinking, analytical, investigative and research skills, including data analysis and presentation and to
  • An understanding of the benefits in developing strategic relationships that partner to ensure the effective use of all available data and information opportunities.
  • Conceptual, analytical, and problem-solving skills as well as drawing reasoned influences from qualitative and quantitative data and to reach robust and practical conclusions.
  • An ability to conduct legal analysis, research, interpretation and applying financial services legislation and policy to the financial sector.
  • Some exposure to, or an understanding of analysing quantitative and qualitative data.
  • Experience presenting information to different audiences through strong business writing and verbal communication.
  • Ability to take a well-considered, forward thinking, and planned approach to problem solving (with strong business acumen), responding with agility and flexibility to change.
  • Experience managing relationships with industry and other stakeholders.
