The Senior Legal Case Manager, Native Title (NT) is a key member of a team supporting Judges, Registrars, parties and legal practitioners to manage designated native title claims to resolution through litigation and/or associated alternative dispute resolution. The Senior Legal Case Manager NT also provides high-level administrative support to the Court in relation to native title claims generally. The Senior Legal Case Manager reports to the National Judicial Registrar and District Registrars, Native Title.
The position involves the following functions:
- Assist the Registrar in the planning and case management of native title matters including in the preparation for mediations and conferences of experts.
- Supports Registrars by planning and preparing for remote/on-country hearings, both contested and by consent.
- Develop and maintain relationships with Court users, liaising with parties to progress matters while being responsive to stakeholder needs.
- Maintain a well-developed knowledge of commonly used legislation and Court procedures. While providing timely and accurate information about the jurisdiction, relevant legislation and the procedures of the Court to parties and stakeholders.
- Use Court applications and associated documentation to accurately enter and maintain information on Court databases, enter and disseminate listing information, and manage Court records.
- Assist with special projects as required.
Provide Quality Client Services
- Provide information and respond to enquiries about native title processes and procedures from legal practitioners and parties, including self-represented litigants.
- Liaise with docket Judges’ chambers, supervising Registrars and parties regarding listing Native Title matters and publishing orders.
- Manage the Registrar’s listings
- Communicate with and notify the NNTT in accordance with the Native Title Act 1993.
- Manage and provide caseload information and statistics for workload projections and budgets.
- Provide general administrative assistance in management of native title caseload, including accurate entry of information on the case management system.
- Maintain expertise regarding native title matters and technical knowledge regarding management of these matters in the Court.
- Coordinate arrangements for stakeholder forums as required.
- Develop agendas and prepare draft outcomes for mediation and case management conferences. Finalise the documents after liaising with the parties and Registrar.
- Maintain electronic records necessary to support the case management and listing of native title matters and the statistical reporting of the Court’s mediation and ADR practice.
- Monitor compliance with orders by parties.
- Generate correspondence advising parties of listings.
- Arrange video-conferencing and courtroom bookings for listings.
- Process documents and case related material, including documents that are eLodged.
- Ensure that native title files are maintained in accordance with filing protocols.
- On-country and remote hearings
- Plan, manage and cost logistical arrangements for on-country and remote hearings and listings.
- Book venues and any associated travel and accommodation.
- Attend on-country and remote hearings.
- Pro-actively assist team members and other colleagues whenever the need arises.
- Support the Registrars in budget and reporting preparation and financial acquittals.
Selection Criteria
- Demonstrated ability to provide high-level case management and administrative support to Registrars (or a similar professional group), including demonstrated commitment to excellence in service delivery, attention to detail and strong research ability.
- Demonstrated ability to take responsibility for achieving a wide range of work outcomes within agreed timeframes, including through working autonomously and/or through supervising junior staff and building team capacity.
- Strong oral, written and interpersonal communication skills in relation to complex matters, with proven ability to develop and support complex professional relationships. Be able to exercise tact and discretion, act impartially and maintain confidentiality.
- Demonstrated proficiency with technology, particularly ability to quickly learn and use the court’s case management database (Casetrack), SharePoint, Microsoft office and other records management systems.
- Demonstrated ability to working effectively in a team in a flexible and adaptable manner, contributing to strategic planning and delivering strategic and operational outcomes.
- Demonstrated understanding of the jurisdiction of the Federal Court, in particular the Native Title jurisdiction.
- Legal work experience and qualifications are highly regarded.
- Previous native title experience or experience working on Indigenous issues is highly regarded.
- Flexibility to travel as required;
- Open driver’s license; and
- Ability to obtain first aid and 4WD qualifications.
