Project Overview
The Queensland Government's Queensland Train Manufacturing Program (QTMP) was established to meet the increasing demand for rail transport in South East Queensland over the next 10 years.
QTMP includes:
- construction of 65 six-car passenger trains
- construction of a purpose-built manufacturing facility at Torbanlea, in the Maryborough region for major manufacturing/assembly works for the new fleet
- construction of a new rail facility (for train maintenance and stabling) in Ormeau
- the ongoing operation and maintenance of the fleet and rail facility.
Earlier this year, Downer was announced as the preferred applicant to deliver the program. The contract will be awarded by mid-2023. Hyundai Rotem Company (HRC) will be a subcontractor to Downer.
Subject to contract award, the HRC design engineering team will integrate the train subsystems design and deliver the manufacturing documentation for the trains that will be manufactured at the new manufacturing facility, in cooperation with Fraser Coast and Queensland rollingstock equipment local suppliers. The design team will work with suppliers to assure the train sets design submissions, compliance, manufacturability, reliability, maintainability and safety for the train’s operational life of a minimum of 35 years.
Role Overview
- Proactive leadership in the delivery of best practice Commercial and Contract Management to the Project Delivery Team:
- To effectively deliver in a timely manner the QTMP trains utilizing HRC Engineering and Procurement teams in conjunction with Downer manufacturing on behalf of Hyundai Rotem Company.
- To lead and direct all commercial, financial and technical matters in line with the project plan and client requirements. Provide daily, monthly, quarterly plans and systems of tracking the project to ensure compliance with HRC corporate policy and client deliverables.
- To developstrategies to ensure QTMP is delivered in line with client expectations and changes that may occur through the life of the project. Understand and mitigate risk to project deliverables with a keen focus on optimising HRC profitability and branding/reputation.
- To work with the HRC Australian Brach Office (HRCABO) on other further project opportunities in Australia and near-by regions, when and as requested by HRCABO.
- To build a productive relationship with all relevant partners on the project. To manage Variations and Directions from DTMR/Downer.
- Ensure full compliance with the QTMP project deed and subcontract between HRC and Downer.
- The success of the Commercial Manager is measured and linked to the success of the Project Delivery Team and the Project.
Key Responsibilities
- Provide commercial and contract management during the performance of projects to all Project Functions
- Develop and maintain an obligation and rights matrix of the Project terms and requirements. Ensure compliance in consultation with project team
- Responsible for proactively seeking opportunities to improve the project’s scope, revenue and margin through effective management of the contract and the implementation of a variation order and claim management processes.
- Developing and implementing commercial and contract management tools, processes and training,
- Ensuring representation of the Commercial and Contract Management priorities,
- Lead the identification and development of contract variations for project, collaborating with all other functions, subcontractors and partners as applicable.
- Responsible to lead the project payment claims preparation and submissions including the bonding arrangements, insurances, including supporting documents both internally and via subcontractors.
- Familiarise with the Abatement/Attribution process, where applicable for Project, and lead to share information with other Project functions for understanding.
- Responsible for developing, updating and concluding contractual claims for ongoing project activity.
- Provide leadership, guidance and advice to project teams on the administration of contracts, interpretation of contractual provisions and securing entitlements to variations and extensions of time.
- Drafting contractual notices, escalations, responses and claims.
- Coordinating external legal and claim consultants, including assessments, shortlisting, selection and work activities.
- Supports and provides guidance to Procurement concerning contractual issues involving Purchase Contracts (e.g. the placement of major Purchase Contracts, supplier non-conformity and variation order requests) and leads the preparation of claims involving suppliers.
- Responsible for bonds management including coordinating bonds release through finance, collection/return with Bank, submission to beneficiary and release.
- Participate in and manage agreements on commercial issues for the project.
- Lead the review, assessment and mitigation of contractual and commercial risks for the project.
- Lead preparation and management of consultancy, sub-contract and Project related agreements.
- Responsible for ensuring appropriate insurance cover and certificates of currency appropriate for the project.
- Regularly attend the Project team meetings and contribute in the form of commercial views and comments on the issues.
- Prepare and conduct training sessions for other project functions for contractual awareness and specific commercial subjects.
- Conduct reviews of commercial and financial performance of projects with Project Managers in consultation with the commissioning and warranty Managers and Engineering Manager.
- Preparing, reviewing and finalising the Project reports as required for internal and external stakeholders.
- Obtaining and maintaining required commercial permissions, licenses, registrations, agreements and access for Project execution.
- Carry out reviews of project team compliance with commercial and financial reporting requirements.
- Work to develop, streamline and implement effective commercial policies and procedures.
Selection Criteria
- Working understanding of the key legislative instruments in Australia eg. WHS Act 2011 (Qld), Rail Safety National Law Act 2012, and Corporations Act.
- Previous experience in delivery, introduction in service, and contract management on major rolling stock projects.
- Excellent leadership and management skills to lead and manage internal and external stakeholders.
- Excellent written/verbal communication skills, including presentations to external stakeholders.
- Strong negotiation and influencing skills and the ability to establish effective working relationships with a variety of people at different levels both internally and externally.
- Demonstrated ability to work in a team and independently to organise and prioritise demands.
- Strong planning skills to handle multiple complex tasks simultaneously, set and meet deadlines and follow-through within a fast-paced environment with multiple and competing demands.
- Proficient skills in computers: MS Word, Excel, Power Point, Email, Sharepoint, Teambinder.
- Knowledge of legal terminology and contract management.
- A degree in Commerce, or Business Law, or equivalent.
- Minimum of 5 years’ experience in a commercial management role within railway industry.
