Currently, there are around 4.3 million Australians with a disability. The National Disability Insurance Agency (NDIA) implements the National Disability Insurance Scheme (NDIS), which is one of the biggest social reforms in the country since Medicare. As an Agency, we support more than 600,000 participants with a significant and permanent disability, and the families and carers of those living with disability.
For many Australians, this will be the first time they receive the disability support they need. The NDIA is designed to enhance the quality of life and increase economic and social participation for people with disability and will mean a peace of mind for every Australian.
The Legal function of the National Disability Insurance Agency (NDIA) has multiple EL2 Lawyer roles available in both the Chief Counsel Division and General Counsel Division.
The Chief Counsel Division – is responsible for the Administrative Appeals Tribunal (AAT), Dispute Resolution and Litigation (DR&L), Legislation & Legal Policy, Fraud Fusion & General Advice & Legislation (GAL) teams.
The General Counsel Division - is responsible for the operation of Legal Service that include Information Law & Privacy (ILP), Commercial Law, Employment Law, Releases and Resolutions & Agency Integrity teams.

in the Chief Counsel Division, is the Agency’s in-house legal practice servicing the Agency with legal advice and litigation support services on merits review matters for participants in the Administrative Appeals Tribunal (AAT). The AAT function is responsible for managing applications made to the Administrative Appeals Tribunal (sometimes called the AAT or the Tribunal) for external review of reviewable decisions made by the Agency these reviews might occur in state or territory courts, federal courts or tribunals.
The Legislation & Legal Policy Branch in the Chief Counsel Division, work closely with the Fraud Fusion Taskforce Team to provide legal advice, assurance, and support services to ensure integrity matters are conducted in accordance with relevant legislation. Common issues requiring legal assistance, including general support to criminal investigations, advice on claims for legal professional privilege on seized material and legal support to the governance of the Fraud Fusion Taskforce Team.
The Fraud Fusion Taskforce Team has been established to detect and prevent fraud in the NDIS and to strengthen the Commonwealth’s fraud detection and response capability. The FFT coordinates intelligence sharing, identification and response by the NDIA and its partner agencies, including law enforcement and regulators.
The Legal Services Branch, in the General Counsel division, consists of five key teams that support business areas with legal advice and support services on areas of law including:
• Corporate and Commercial – contracts and grant agreements, public interest disclosures, property, intellectual property, probity and commercial dispute resolution
• Employment and Workforce– employment law, work health & safety
• Releases and Resolution – coronial matters, managing requests for protected Agency information from justice related stakeholders (e.g., police, child protection agencies, public guardians, courts, tribunals and lawyers) where it is not possible or practicable to obtain consent from the person the information is about; and
• Information Law and Privacy - legal advice or assistance relating to the use, collection, disclosure or handling of personal information, sharing personal information with third parties or complying with the NDIA's information handling obligations and integrity matters.
• Agency integrity – legal advice or assistance with obligations arising from the National Anti-Corruption Commission Act 2022 (Cth) and Public Interest Disclosure Act 2013 (Cth) and matters relating to building the NDIA’s ethical capability.
The ideal candidate will possess excellent technical legal skills and demonstrated experience in leading legal teams to deliver high value outcomes for the NDIA. You will have the ability to thrive in a busy team environment. You will be passionate about growing the skills and capabilities of your team, as well as being effective at stakeholder management with the ability to build mutually beneficial relationships.
You will be required to represent and negotiate on behalf of the Agency to advance the Agency’s interests in cross-agency, inter-jurisdictional and other forums.
This position is within the legal job stream and the candidate must possess relevant academic qualifications with admission as a legal practitioner, however described, of the High Court or the Supreme Court of an Australian State or Territory, and hold a current practising certificate.
Experience in, or knowledge of the following areas will be favourable for:
Administrative Appeals Tribunal (AAT), Dispute Resolution and Litigation (DR&L) Branch:
• Administrative law, statutory interpretation, and principles of good administrative decision-making.
• Alternative Dispute Resolution
• Litigation, including in Commonwealth or State/Territory Tribunals.
• National Disability Insurance Scheme Act 2013 and National Disability Insurance Scheme (Supports for Participants) Rules 2013
The Legislation & Legal Policy Branch & Legal Services Branch:
• Administrative law, statutory interpretation, and principles of good administrative decision-making.
• Corporate and Commercial Law.
• Information and Privacy Law.
• Compensation, including statutory schemes.
• Public Law including Commonwealth Government
• Employment Law
• Integrity matters (i.e., National Anti-Corruption Commission and public interest disclosure matters).

While this role is ideally performed from Deakin – ACT, Surry Hills – NSW, Brisbane – QLD, Adelaide – SA, Geelong & Richmond – VIC, remote working arrangements may be considered. We intend to fill this role in an ongoing capacity, however non-ongoing roles up to 12 months with a possibility of extension of up to two years may be offered.
Successful candidates will be required to undergo a pre-employment National Police History check, Worker Screening check and/or Working with Children Check (where required) and provide evidence of Australian Citizenship.
