In-house Lawyer Worker’s Compensation
Our client is seeking an experienced In-house lawyer that will report to the Executive Manager Managing Partner in the Worker’s Compensation team. You will manage a portfolio of claims with the purpose of achieving safe, fast and durable return-to-work outcomes for injured workers and their line managers within the relevant legal requirements. We are seeking someone with:
- 2-5 years PQE
- Making all relevant determinations (decisions) on claims as per the applicable legislative requirements;
- Obtaining and examining all relevant information concerning the injured worker and their claim;
- Implementing and managing effective rehabilitation programs with the view to safe, durable and timely return to work outcomes;
- Devising and implementing an effective strategic plan;
- Demonstrating compliance with the organisation’s processes and the applicable legal framework; and
- Informing and engaging all relevant parties in the process and plan implementation.

- Manage the provision of legal and policy advice to ensure legal and policy issues are professionally addressed to meet stakeholder needs and legislative requirements.
- Interpret, communicate and explain complex legal issues for the Commission and prepare documents to provide guidance on the legal implications of decisions and actions.
- Provide expert advice, recommendations and solutions on statutory interpretation and administrative law issues
- Manage, lead and negotiate outcomes with the parties to disputes and their representatives, and apply appropriate dispute resolution approaches,
- Develop and maintain strong working relationships with approved lawyers to ensure the achievement of objectives, compliance and optimal service delivery
- Undertake legal and policy research and analysis and provide recommendations and develop solutions on complex matters.
Your Responsibilities
Conduct initial contact on claims to determine the rehabilitation and other support required for the injured worker and the information needed to determine the organisation’s liability for the worker's injury- Initiate and coordinate activities to engage appropriate support (including early intervention if required) for the worker and their line manager
- Co-ordinate activities to obtain information from all relevant parties for determination of the Organisation’s liability and to formulate a proactive strategic plan
- Record information (electronic and hard copy file) within the relevant timeframes
- Advise relevant parties (verbally and in writing) of the claims process and their legal obligations, and responsibilities relevant to the case
- Engage the worker, line manager and other relevant parties (including a Rehabilitation Provider) in the management of the case as appropriate
- Participate in case conferences as required
- Conduct regular case reviews to ensure the strategic plan remains the most appropriate
- Determining liability in accordance with the Safety, Rehabilitation and Compensation (SRC) Act 1988 and all subsequent determinations for compensation
- Regular review of claim status and liability to ensure the correct or preferable decision is maintained
- Participate in ongoing learning to ensure up-to-date legislation and best practice is used to manage cases
- Carry out tasks in accordance with the organisation’s EEO and OH&S principles and practices and the Statement of Professional Practice
- Case management of all workers' compensation claims within the portfolio, according to defined processes and the relevant legislation
- Approve all payments relevant to the case, within delegated authority
- Escalation of the case to specialist advisers according to defined processes
- Represent the Organisation at external forums and to external authorities (ie: conciliations, compensation tribunals etc), where required
