Job Purpose
The role of Senior Commercial Manager is to:
• Provide commercial and contractual expertise and services during the performance of all projects under the control of Manufacturing & Maintenance and to ensure contract requirements are adhered to and the best interests of UGL are maximised.
• Promote, encourage and ensure management and implementation of effective commercial practices, including all legal, compliance, insurance and procurement activities.
• Lead, support and coach a highly effective and motivated team operating in a ‘service provision’ environment.
• Work with the National Commercial Manager to develop and implement commercial policies and procedures as applicable.
• Understand and implement commercial practices as contained in UGL policies, procedures and guidelines.
• Direct Commercial leadership of all projects in additional to overall commercial governance for Manufacturing & Maintenance.
Responsibilities
• Provide Commercial governance and guidance for the broader leadership team within this Line of Business.
• Tender commercial reviews (MCT’s) and liaison with legal to gain relevant approvals including client negotiations.
• Provide commercial support for the start-up / mobilisation work required on new projects.
• Supply commercial support to the state operations and projects as appropriate.
• Provide insurance support to Manufacturing & Maintenance leadership and project teams.
• Provide advice on contract interpretations and disputes, including client negotiations.
• Undertake project reviews across the Manufacturing & Maintenance line of business.
• Cost to complete reviews of projects across the Manufacturing & Maintenance line of business.
• Operate and maintain commercial systems and procedures that will meet the needs of Transport.
• Ensure that high quality and timely advice is provided in accordance with both UGL policies and processes.
• Develop and maintain effective and collaborative relationships with key stakeholders including customers and Clients.
• Maintain positive and effective communication channels and protocol between the Commercial team and the business.
• Provide guidance to the business ensuring governance systems are in place to achieve the objectives.
• Ensure contracts are administered to ensure that all activities, responsibilities and obligations of the contract are met in a timely, accurate, effective and compliant matter.
• Project delivery risks are managed, including effective resolution of disputes.
• Advice is provided to projects, planning, and production departments of contractual rights and obligations in a clear, concise and understandable manner.
• Appropriate claims are made where necessary.
• Complete contractual records are maintained, including correspondence, proposed changes to contracts, warranties, delays, extensions of time and other contract management functions.
• Effective communication is maintained with a diverse range of external and internal stakeholders.
• Ensure adequate commercial support is provided to the procurement teams to achieve their objectives
• Standard contractual documents are used / developed to cater for a diverse range of suppliers and commercial support is provided during the contract negotiation phase in relation to any deviations from those standards.
• Assist in the development and preparation of clear, concise performance based contract management plans that cost effectively measure contract performance and provide guidance on administering the contract.
• Commercial support is provided in relation to preparation of claims against suppliers and effective resolution of those claims.
• Ensure projects implement a robust program/schedule that supports delay and prolongation claims
• Ensure project team implement effective subcontractor management processes including procurement pre-engagement and ongoing delivery
• Ensure compliance with all record keeping requirements.
• Ensure all required projects maintain a Margin Enhancement Process
Qualifications
• Minimum of 8 years’ experience in a Commercial management related role within an engineering, project management, Aviation, Automotive or manufacturing environment.
• Ability to achieve outcomes in an environment of managing complex stakeholder relationships, including key business partners.
• An advanced knowledge of contacts and legal terminology.
• Degree in Commerce or Business, Law, Accounting or an engineering discipline is highly desired.
• Strong communication skills (oral & written) including strong negotiation and influencing skills and the ability to establish effective working relationships with a variety of people at different levels both internally and externally.
