Job description

The Aged Care Quality and Safety Commission (the Commission) was formed on 1 January 2019. The role of the Commission is to protect and enhance the safety, health, wellbeing and quality of life of people receiving aged care.

The Commission is the national end-to-end regulator of aged care services and the primary point of contact for consumers and providers in relation to quality and safety. Our vision is to support a world-class aged care system driven by empowered consumers who enjoy the best possible quality of life.

We aim to build confidence and trust in aged care, empower consumers, promote best practice service provision, promote quality standards and hold providers to account for their performance against the expected standards of care. We seek to promote an aged care system that develops safer systems of care, inculcates a culture of safety and quality, and learns from mistakes, while providing the oversight that can assure the community that aged care services are operating as they should, including working on continuous improvement.

Position Description

An opportunity exists as one of the Review Managers in the Reviews and Reconsiderations section in Regulatory Policy and Intelligence Group.

The purpose of the position is to support the Commission’s legislated responsibilities in relation to reviewable regulatory and complaints decisions under the Aged Care Quality and Safety Commission Act 2018 and associated Rules. The section also has portfolio responsibility for the interface with the Inspector-General of Aged Care and the Commonwealth Ombudsman.

Position Duties

  • Supporting the Commission’s obligation to maintain an independent internal review mechanism, in line with expectations of government bodies.
  • Undertaking merit-based reviews and reconsiderations of regulatory decisions, such as provider approval, quality assessment, compliance, banning order and complaints decisions, in accordance with the Aged Care Quality and Safety Commission Rules Act and Rules. Undertake new complaint resolution processes for more complex, sensitive or high-priority complaints.
  • Making decisions as a delegate for selected reviews, requiring you to make fair, correct and preferable decisions in line with administrative law principles.
  • Supporting the team’s role to manage the interface between the Commission and the Inspector-General of Aged Care including assisting management of information requests and coordinating Commission responses to inquiries. 
  • Supporting the team’s role in responding on behalf of the Commission to Commonwealth Ombudsman requests and investigations.
  • Leading and supervising a small team of Review Officers to conduct effective reviews and produce high-quality reports and recommendations while providing feedback and supporting their performance.
  • Demonstrating excellent judgement, expertise and knowledge while identifying, managing and escalating risks to consumers, providers and the Commission. Engaging with specialist advice (e.g. legal and/or clinical) to ensure technically accurate and defensible decisions.
  • Working with the Review Director to balance individual priorities in order to meet legislated timeframes.
  • Working constructively with consumers, providers and other stakeholders to take relevant and proportionate action to promote regulatory compliance and achieve improved consumer outcomes.
  • Applying comprehensive work knowledge, precedent and established legislation, policy, procedures and guidelines to situations involving a high level of complexity and sensitivity which require considerable interpretation and analysis.
  • Managing relationships with stakeholders with a high degree of independence and understanding the requirements and processes of related areas of the Commission.
  • Contributing to the Group’s role in continuous improvement, including preparing feedback, monitoring trends, identifying training needs and contributing to projects to support decision-making capabilities across the Commission. Also contributing to the continuous improvement of the team’s processes and practices.

Position Eligibility Requirements

  • Highly developed investigation, resolution, negotiation and decision-making skills, including experience in managing more sensitive and difficult cases with a high degree of independence.
  • Demonstrated skills and experience in applying administrative law and decision-making principles to support and produce fair, correct and preferable decisions.
  • Ability to supervise and mentor others to conduct targeted and effective reviews and reconsiderations and produce high-quality outcomes and recommendations.
  • A highly motivated, engaged, flexible and resilient approach, including capacity to engage with a wide range of internal and external stakeholders (particularly aged care providers and complainants).
  • Capacity to work in a fast-paced environment with demonstrated skills in time management, working with competing priorities and ability to prioritise and manage a case load.
  • Persuasive written and verbal communication skills including a capacity to negotiate outcomes and resolve conflict with internal and external stakeholders.
  • Demonstrated ability to undertake and make delegated review and reconsideration decisions, or otherwise prepare draft reports and recommended decisions for a delegate which include clear, evidence-based reasons to support sound decisions.
  • Ability to identify practice and policy issues arising from reviews and make strategic recommendations to support group goals.
  • Excellent knowledge of relevant legislation and good knowledge of the Australian aged care system and its regulation.
  • Ability to engage with risk, including the conduct of risk assessments and risk management activities for area of responsibility.
  • Willingness to build capability in a national team environment through coaching others, providing performance feedback, conflict resolution and encouraging career development.

Desirable qualifications or experience 

  • Understanding of the Australian aged care system
  • Experience in undertaking merit-based reviews
  • Comprehensive understanding of administrative decision-making principles
  • Clinical qualifications and experience, particularly in aged care, are desirable though not essential.

Position Notes

Salary offered will be between $109,853 and $125,288 per annum depending on skills and experience. In addition, 15.4% superannuation will be paid.
