The team
ASIC's Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC's initial inquiries, compliance and enforcement work across all sectors. The ECG comprises a number of teams, including Investigation and Enforcement Action Teams.
This recruitment process will establish a pool of lawyers and investigators to fill current and future positions in our Investigation and Enforcement Action Teams.
The role
As a Senior Lawyer/Investigator in one of our Investigation and Enforcement Action Teams, you will report to the Senior Manager and:
- work across a range of large and complex investigations into suspected misconduct
- guide investigative teams in the development of investigation strategy, legal issues, planning and conduct of investigations
- lead and manage resources to ensure timely and effective enforcement outcomes
- identify and deal with issues, including complex legal issues, arising in investigations that present challenges
- interview and obtain information from a range of witnesses, and develop relationships with witnesses
- give evidence at civil and criminal hearings about investigations
- communicate with external parties in relation to issues arising during the course of investigations
- compile briefs for the Commonwealth Director of Public Prosecution and assisting them to prepare for and conduct criminal prosecutions
- support ASIC inhouse Litigation Counsel in commencing and conducting civil litigation in the Supreme and/or Federal Courts, including briefing and instructing Counsel
- compile administrative briefs to ASIC delegates, liaise with delegates and represent ASIC at administrative hearings
- provide written and oral briefings to Senior Executives, Executive Directors and Commissioners.

Ideally, you will possess:
- significant experience in a senior role that involves investigation, case management, evidence gathering processes, project management and/or detection of misconduct, including the conduct of civil litigation and the preparation of criminal briefs of evidence
- experience in conducting complex litigation
- strong legislative and evidence analysis skills
- an understanding of the law, practice and policy relating to the Corporations Act, the National Consumer Credit regime, the ASIC Act and other relevant financial services legislation
- highly developed writing and drafting skills and the ability to communicate verbally in a clear, concise and persuasive manner
- demonstrated ability to use digital investigative tools
- confidence in presenting, building rapport, interviewing and advocating an organisation's position in the context of complex issues
- experience in guiding and coaching other team members.
