The Senior Regulatory Lawyer is a key role within the Group’s centralised Governance team, trusted to advise its executives and licensees in order to meet their regulatory obligations, particularly financial services laws.
The role works closely with the Group’s Risk & Compliance teams and senior managers within Envest’s 20+ Australian financial services licensees, supporting the objectives of the Group’s regulatory framework, product development and distribution in a dynamic environment.
Key Responsibilities will include:
- Providing advice on financial services legislation and regulatory codes relevant to general insurance and insurance distribution, including the Corporations Act, ASIC Act, Insurance Contracts Act and insurance industry codes of practice.
- Drafting and advising on disclosure documents (PDSs, FSGs), customer terms and conditions, distribution agreements, insurance binders, referral arrangements, broker TOBAs and other insurance related contracts.
- Supporting engagement with regulators, regulatory reporting, submissions to industry bodies and regulators, assisting with any regulatory queries or investigations.
- Providing the Compliance team with technical support where required on breach assessments, regulatory reporting and complaints management.
- Updating the business on relevant regulatory developments and practice and supporting training and education to assist understanding of obligations.
- Fostering a positive compliance culture within the organisation.
- Preparing advice and detailed reports for the Audit, Risk & Compliance Committee or leaders in the business as required.
- Drafting, reviewing and negotiating commercial contracts including supplier agreements, software agreements and outsourcing arrangements.
- Managing matters briefed to external lawyers.
- 7+ years’ legal experience in financial services and insurance law.
- Experience with insurance intermediaries and distribution.
- General commercial and corporate experience.
- Demonstrated capability of engaging and influencing a wide variety of stakeholders, with clarity to positively impact and influence regulatory behaviours.
