We value those with sharp, analytical minds and are open to challenging the way things are done.The teamThe Credit, Banking & General Insurance team is the team primarily responsible for the regulation and supervision of the credit, banking, payments, debt management, and General Insurance sectors. This includes proactive engagement with and monitoring of firms and the sector overall. This team coordinates and provides strategic direction, industry knowledge and technical expertise for ASIC's work in these sectors.The team conducts analysis, research, proactive supervision, monitoring, and engagement work (with a view to appropriate regulatory outcomes), considers applications for relief from legislative requirements, provides specialist support to regulatory reform activities, and actively engages with relevant stakeholders regularly to understand and respond to current and emerging industry issues. The team provides assistance to other teams within ASIC to enable them to carry out their roles, especially the carrying out of compliance and enforcement action.The Indigenous Outreach Program (IOP) is also within the Credit, Banking & General Insurance team, focusing on consumer protection issues for Indigenous consumers.The roleAs a Senior Analyst/Lawyer you will be accountable for:
  • Leading risk-based supervision and analysing regulatory issues.
  • Developing, reviewing, and interpreting policy and regulatory guides.
  • Leading and identifying new ways to utilise data to deliver priorities.
  • Collaborating with the Sector Leadership team in the development of sector strategy and priorities.
  • Leading and managing sector engagement initiatives alongside and in collaboration with other team members.
  • Establishing and maintaining relationships with key internal and external stakeholders to effectively deliver the sector strategy.
  • Supporting the implementation of policy and law reform, including development of new guidance, training, systems, and processes.
  • Identifying potential areas for law reform and assisting in the law reform projects.
  • Partnering with the broader Superannuation and Life Insurance team to ensure that ASIC's role in the insurance sector is clear, understood publicly and operationalised.
  • Leading and participating in project teams on emerging issues across the sector.
  • Writing reports and communication materials such as presentations, briefing notes and website content.
  • Mentoring and supervising work of others, as required, to ensure the delivery of quality outcomes.
  • Maintaining knowledge of ASIC's regulatory framework and toolkit, relevant legislative and reporting requirements, domestic and international developments, and best industry practice models.
  • Recommending system improvements to optimise long term outcomes and maximise performance.
  • Providing and applying expertise in the assessment of complex matters such as applications for relief and assessments or disclosure and conduct.
  • Considering applications for relief from the legislation administered by ASIC, reviewing the submissions from the applicant (and third parties, as appropriate), consider existing policy and precedents, make a sound recommendation showing regulatory judgment and then prepare the relevant legal instrument to give effect to the relief decision.
  • Undertaking analysis and interpretation and apply significant judgement in choosing a course of action to manage highly complex and/or sensitive issues.
  • Maintaining own knowledge on emerging developments across the sector.
  • Working collaboratively with other teams within ASIC to enable them to carry out their roles, especially the carrying out of enforcement and compliance action.
About you
  • A relevant tertiary qualification.
  • Experience in advising on complex transactions or projects requiring critical thinking and judgment gained working in the relevant industry, legal firm, or a regulatory environment.
  • Knowledge of the Australian financial services and credit industries generally and specifically from a regulatory, product, operations, risk, or client service viewpoint.
  • Experience analysing and considering the broader organisational, industry and environmental context to develop sound and practical solutions to interpreting and applying legislation.
  • Demonstrated ability in delivering strategic priorities through stakeholder engagement and innovative solutions.
  • Proven use of strategic thinking and analytical skills to identify emerging trends and risk areas.
  • Experience delivering results in a complex business environment through a commitment to quality outcomes, managing risks, and the efficient use of resources.
  • Superior writing and drafting skills, and the ability to communicate in a clear, concise and persuasive manner.
  • Strategic thinking, analytical, investigative and research skills, including data analysis and presentation.
  • An understanding of the benefits in developing strategic relationships that partner to ensure the effective use of all available data and information opportunities.
  • Highly developed conceptual, analytical and problem-solving skills as well as drawing reasoned influences from qualitative and quantitative data and to reach robust and practical conclusions.
  • Senior stakeholder management experience including influencing and utilising industry networks.
  • Strong organisational, project management and complex problem-solving skills.
