The purpose of the Nominal Defendant is to administer the payment of damages arising from the liability of uninsured, unidentified motor vehicles and insolvent licensed CTP insurers.
This role is responsible for the management of the claims allocated from the initial assessment and investigation of the claim to the negotiation and settlement. You will use mediation, legal representation and court processes to determine appropriate liability and quantum payments of claims and where necessary the provision of rehabilitation services to injured parties.
The key responsibilities of the Senior Claim Advisor are:
• Applying best practice principles in proactively managing a large portfolio of Compulsory Third Party (CTP) insurance claims in a Common Law environment ensuring that all phases comply with the timeframes prescribed by legislation and the courts.
• Assess liability by undertaking thorough investigations through liaising with internal and external stakeholders and put forward recommendations to management on acceptance or denial of liability.
• Maintain up-to-date claim estimates by undertaking review of all available medical evidence and in accordance with procedural requirements.
• Undertake full review of a claim to determine applicable damages, including all obtained medical evidence and legal opinion to put forward recommendations to management on damages to be negotiated as well as strategy for settlement.
• Mentor and guide Claims Assessors to ensure compliance with internal policies, procedures and guidelines as well as contributing to a culture of continuous improvement.
• Collaborate with internal service providers such as the Technical Advisor on claims strategy.
• Assess and determine appropriate rehabilitation programs for injured parties as required by liaising with internal and external service providers.
• Assess whether to appoint external parties including private investigators, solicitors or barristers to specific cases, and if appropriate, brief, instruct, case manage and assess the performance and fees charged by these parties.
• Negotiate appropriate direct settlement of claims with the claimant or solicitors acting for the claimant and approve settlements, legal and other expenses in accordance with delegations.
• Represent the organisation at settlements, court hearings, conferences and negotiations and provide instructions as appropriate.
To be successful in this role you will need to demonstrate:
• Experience in managing claims under the Motor Accident Insurance Act 1994 utilising best practice claims standards.
• A sound understanding of liability and knowledge of applicable case law.
• The ability to assess the quantum of a personal injury claims including the application of the Civil Liability Act 2003 & Regulation.
