Job Description QLS has a Part-time permanent opportunity for a Fidelity Fund Solicitor to join the Regulation team. The purpose of the Regulation Division is to manage the receipt and investigation of claims against the Fidelity Guarantee Fund and the payment of claims from the Fidelity Guarantee Fund. In this role you will: To investigate claims made on the Fidelity Guarantee Fund and report on those investigations to the Committee of Management making a recommendation as to the action that Committee should take on the claim. To investigate and report on the fitness of practitioners to practise arising out of defaults of trust money or property. To advise on the application of the Legal Profession Act 2007 to the conduct of the Legal Practitioners' Fidelity Guarantee Fund. And some of your key accountabilities include: Provide legal advice and support regarding the Fidelity Guarantee Fund. Provide legal advice and assistance in licensing matters arising from defaults or alleged defaults as that word is defined in the Act, including the investigation of such matters and submissions for consideration by the General Manager Regulation and the Executive Committee of Council. Respond to enquiries about potential claims against the Fidelity Guarantee Fund. Investigate and prepare reports about claims against the Fidelity Guarantee Fund for consideration by the Committee of Management. Prepare Information Notices of the decisions of the Committee of Management. Prepare applications for the appointment of Supervisors of Trust Money, Receivers and Mangers of law practices by the Society. Instruct the Office of General Counsel to provide legal advice in relation to the administration of the Fidelity Guarantee Fund. Instruct Office of General Counsel to act for the Society in defending appeals against decisions by the Committee of Management about claims against the Fidelity Guarantee Fund. Desired Skills and Experience Qualifications Tertiary qualifications in law. Extensive experience in a legal practice is highly desirable. Extensive experience in undertaking investigations within a professional / ethical or similar environment. Ability to interpret and apply the provisions of the Legal Profession Act 2007 and the Legal Profession Regulation 2017 and other legislation applicable to the operations of law practices. Ability to examine legal accounting records and client files to ascertain whether client funds have been properly handled.
